AGREEMENT These Terms of Service ("Terms") govern your use of the LPG Go mobile applications and related services (the "Platform"), operated by Advanced Market Solutions & Technologies Corporation ("LPG Go", "we", "us"). By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform. 2. WHAT THE PLATFORM IS — AND IS NOT The Platform connects customers with independent, accredited LPG dealers and riders ("Providers"). We are a marketplace and facilitator. We are not a seller of LPG. We do not own, refill, store, or transport LPG cylinders. The sale is between you and the Provider you select. The Provider is solely responsible for the quality, weight, safety, and condition of the LPG cylinder and any accessories supplied; for compliance with all applicable laws, permits, and safety standards governing the sale, handling, and transport of LPG; and for the conduct of the delivery, including the acts of its riders. 3. ELIGIBILITY AND ACCOUNTS You must be at least 18 years old and legally capable of entering into contracts. To use the Platform you must register an account using a valid Philippine mobile number. You agree to provide accurate and current information; to keep your account credentials and one-time passwords confidential; not to share, sell, or transfer your account; and to notify us promptly of any unauthorized use. You are responsible for all activity under your account. We may suspend or terminate an account that violates these Terms, is used fraudulently, or poses a safety risk. 4. PROVIDERS: ADDITIONAL TERMS Dealers and riders must, in addition, submit and maintain valid accreditation documents, including a Mayor's Permit for dealers and a Driver's License for riders, and any other document we require; hold and maintain all licences, permits, and insurance required by law for the sale, storage, handling, and transport of LPG; comply with the Provider Compliance and Indemnity Undertaking accepted at registration, which forms part of these Terms; complete required safety checks and log them accurately in the app; and maintain a sufficient credit balance for admin fees, where applicable. Providers are independent contractors. Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship between LPG Go and any Provider. 5. ORDERS Placing an order. You select the brand, size, and quantity, set your delivery address, and submit the order. Your order is broadcast to eligible Providers. Selecting a Provider. Where Providers respond with offers, you choose one. Once you confirm, a binding contract of sale is formed between you and that Provider. Prices and fees. Prices are set by Providers and shown before you confirm. Delivery fees, express delivery fees where selected, and any applicable platform or admin fees are shown at checkout. Prices may change between orders. Order limits. We may limit the number of orders you may have active at one time. Expiry. Orders that receive no Provider response within the applicable window may expire automatically. 6. PAYMENT Accepted payment methods are shown at checkout and may include cash on delivery and electronic payment through our payment processor. Electronic payments are processed by PayMongo. We do not store your full card or e-wallet credentials. For cash on delivery, you must pay the Provider the exact amount due on delivery. You are responsible for any bank, e-wallet, or processing charges imposed by your payment provider. 7. DELIVERY, CANCELLATION, AND REFUNDS Delivery. Estimated arrival times are estimates only and are not guaranteed. You must be available to receive the order at the address given, and to accept the cylinder. Cancellation by you. You may cancel free of charge at any time before a Provider is assigned to your order. Once a rider is in transit, cancellation is not permitted. Cancellation by a Provider or by us. An order may be cancelled where the product is unavailable, the address cannot be reached, delivery would be unsafe or unlawful, or fraud is suspected. Refunds. Refunds for prepaid orders are processed to the original payment method within 7 business days. That period is the time for us to initiate the refund. How long it then takes to appear on your statement is determined by your payment provider and issuing bank, and is outside our control. Disputes about product quality, weight, or condition are resolved between you and the Provider; we will assist in good faith but are not the seller. 8. SAFETY LPG is flammable and hazardous if mishandled. You agree to inspect the cylinder and seal on delivery before accepting it; to report any leak, damage, or defect to the Provider immediately and refuse the delivery; not to require delivery to a location that is unsafe or unlawful to access; and to follow the manufacturer's and the Provider's handling and installation instructions. In case of a suspected leak, do not operate electrical switches or open flames. Ventilate the area, evacuate, and contact emergency services. 9. REVIEWS AND CONTENT You may post ratings and reviews. You agree that your content will not be false, defamatory, obscene, discriminatory, or infringing. We may remove content that violates these Terms, but we do not undertake to monitor all content. You grant us a non-exclusive, royalty-free licence to use, display, and distribute content you post on the Platform in connection with operating and promoting the service. 10. LOYALTY, PROMOTIONS, AND DISCOUNTS Loyalty tiers, promotional discounts, and sign-up offers are subject to their own published mechanics and may be changed, suspended, or withdrawn at any time. Benefits have no cash value, are non-transferable, and are forfeited when an account is closed or found to be abusing the program. 11. PROHIBITED CONDUCT You may not use the Platform for any unlawful purpose; resell LPG obtained through the Platform in violation of applicable law; impersonate another person, or create accounts to evade suspension; interfere with, probe, scrape, reverse engineer, or overload the Platform; harass, threaten, or abuse other users, Providers, riders, or our staff; or submit false, forged, or altered accreditation documents. 12. INTELLECTUAL PROPERTY The Platform, including its software, design, trademarks, and content other than user content and Provider content, is owned by Advanced Market Solutions & Technologies Corporation and protected by law. You receive a limited, revocable, non-exclusive, non-transferable licence to use the apps for their intended purpose. You may not copy, modify, or create derivative works from them. 13. DISCLAIMERS To the fullest extent permitted by law, the Platform is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or secure, or that estimated delivery times will be met. We make no warranty as to the quality, safety, legality, weight, or fitness for purpose of any LPG cylinder or product supplied by a Provider. 14. LIMITATION OF LIABILITY To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or exemplary damages, or for loss of profits, data, goodwill, or business opportunity; we are not liable for the acts or omissions of Providers, including delivery delays, product defects, injury, or property damage arising from LPG supplied or handled by them; and our aggregate liability arising out of or relating to the Platform is limited to the total amount you paid through the Platform in the six months preceding the claim, or PHP 5,000, whichever is lower. Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by our negligence, or for fraud. 15. INDEMNITY You agree to indemnify and hold harmless LPG Go, its officers, employees, and agents from claims, losses, liabilities, and expenses, including reasonable legal fees, arising from your use of the Platform, your breach of these Terms, or your violation of any law or third-party right. Providers additionally indemnify LPG Go in accordance with the Provider Compliance and Indemnity Undertaking. 16. SUSPENSION AND TERMINATION We may suspend or terminate your access at any time for breach of these Terms, suspected fraud, safety risk, or where required by law. You may stop using the Platform and delete your account at any time as described in the Privacy Policy. Sections that by their nature should survive termination, including Sections 12 through 15 and Section 18, survive. 17. PRIVACY Our handling of personal information is described in the LPG Go Privacy Policy, available in the app under Profile, then Privacy Policy, which forms part of these Terms. 18. GOVERNING LAW AND DISPUTES These Terms are governed by the laws of the Republic of the Philippines. Any dispute arising out of or relating to these Terms or the Platform may be brought before the competent courts of Eastern Samar, Philippines, or before the competent courts of the place where you reside, at your election. 19. CHANGES TO THESE TERMS We may update these Terms. If changes are material, we will notify you in the app or by other reasonable means before they take effect.
